Beta terms

EMS is run by Elusive Management (Joey Semaan). “You” is the agency whose owner accepted these terms, at signup or in Settings → Privacy, and everyone that agency adds to its organization.

• EMS costs nothing during the beta.
• Every organization created during the beta is marked billing-exempt. While it's exempt, EMS never asks you to pay and never charges you.
• When the beta ends, Joey tells you at least 30days before any charge. You decide then whether to stay. If you don't, export your data and leave; nothing is charged.

EMS is provided as it is, with no warranty. Things will break, and features will change or go. Joey fixes what he can as fast as he can, but there's no uptime promise during the beta.

Keep your own copies of anything you can't lose: download invoice PDFs, and take the full export from Settings → Privacy now and then. As far as the law allows, Elusive Management (Joey Semaan)isn't liable for lost revenue, lost data or any indirect loss from using the beta.

• You own everything you put in EMS. EMS uses it only to run EMS for you and to answer your support requests.
• Elusive Management is a talent agency too. Nothing in your organization — your roster, deals, rates, brands or contacts — is used for Elusive's own business, or shown to any other agency.
• Joey reads your records only when you ask for help, and only yours. How the data is handled is in the privacy notice.
• Export everything any time from Settings → Privacy → Download all data. Delete the organization from the same page: it goes 30 days later, and you can cancel until then.
• Backups cover the whole database, every agency at once. They can't restore your organization on its own, so your export is your copy.

Joey keeps what's in your organization to himself. You keep what you see of unreleased EMS features, and anything Joey shares about the product, to yourselves.

• You have the right to put your creators' and contacts' details in EMS, and you tell them it's there. The intake form shows creators a data notice before they start.
• Each person signs in with their own Discord account, with a verified email. One agency per Discord account.
• You decide who in your team is an owner. Owners see everything in the organization.
• Keep the bots' finance and meetings channels visible to owners only.
• Don't use EMS for anything unlawful, or to get at another agency's data.

You can stop using EMS any time. Joey can end the beta, or end it for your organization, with 30 days' notice so you can take your export first. If you break these terms in a way that puts other agencies or their data at risk, access can be stopped straight away.
